Answer:
The guidelines do not stipulate use of this option to only established patients. If a patient has a chronic condition; it still could be new to the provider with whom they are being seen. The status of the chronic conditions can be used for any type of E/M as long as the documentation clearly indicates the management of those conditions/status of those conditions.
